EcoHealth Alliance Heads to SCOTUSA widow has petitioned the United States Supreme Court to review a Second Circuit decision that dismissed a wrongful-death lawsuit arising from the COVID-19 infection without allowing a jury to hear the case. The petition challenges whether federal courts, sitting in diversity, may prematurely shut down novel state-law tort claims involving ultrahazardous scientific research — particularly where those claims raise unresolved public-health policy questions traditionally reserved to the States. Petitioner Susan Heath alleges that EcoHealth Alliance knowingly funded and facilitated high-risk gain-of-function coronavirus research through a foreign laboratory with documented biosafety deficiencies, and that this conduct ultimately resulted in the release of SARS-CoV-2 and the death of her husband. Federal investigations and congressional findings issued after the lower-court rulings, the petition argues, have since corroborated the risks underlying those allegations. Rather than allowing New York courts to decide whether such conduct gives rise to negligence or strict liability under state law, the lower federal courts resolved those questions themselves — declining to certify them to New York’s highest court and dismissing the case at the pleading stage. The petition asks the Supreme Court to reaffirm core principles of federalism, jury access, and the Erie doctrine, and to clarify whether courts may effectively confer immunity for dangerous scientific activity by redefining factual allegations and foreclosing state-law remedies before discovery.
